Prices and Availability

Because of the fast-moving nature of the industry, view prices and availability are subject to continuous change without notice. CEW is unable to issue price adjustments on website due to consistent price changes after date of original sale. We do our best to provide the most accurate, for sale up-to-date information, but errors do occur and we reserve the right to make changes without notice. Your CEW Account Executive will inform you when a product is not in stock, and can tell you when we expect the product will be available. Anticipated delivery dates are based upon our vendor supplied information and are subject to change.

Title – Risk of Loss

Title to items being purchased passes from CEW to purchaser at the time of shipping. Customer takes on full liability for safety and validity of delivery address given to us at the time of purchase. CEW will not incur any forwarding costs on shipments. CEW shall not be responsible for damages or delays resulting from Acts of God, war, riot, seizure, terrorist activities, embargo, or other acts or events nothing within the reasonable control of CEW.

Order Cutoff Time

Each order must be credit approved and transmitted to the shipping warehouse and all quantities are checked more than twice before the cutoff time of that warehouse location. Same-day shipping cutoff times vary by warehouse location and may range from 2:00pm EST to as late as 10:00pm EST. If you need further verification regarding your order, please call us at 866-873-4303.

Orders placed and/or credit approved later than the applicable warehouse cutoff time will ship the next business day. Orders placed and credit approved anytime Sunday for in-stock items will ship on the following Monday.

We currently provide no price protection after a purchase has been made

CEW Delivery

To find out when your order will arrive, please consider the product’s availability and which shipping option you want to use. Here’s how we calculate the ETA:

Order Picking + Product Visual Inspection + Shipping Time = Total Delivery Time

Usually we ship products after the Product Visual Inspection which takes two business days. Your total shipping time will be 5-10 business days, depending on your physical shipping address. This means your total delivery time will be two days for (order picking) and (visual inspection) plus 3-7 business days shipping time. So, in this example, you can expect to receive the shipment five to ten business days after you place your order.

Applicable Taxes

Any sales, use or other applicable tax is based on the location to which the order is shipped. If you believe your purchases are not subject to sales tax, please contact your Account Executive for assistance at 866-873-4303.

Canada Electronic World (CEW) Sales & Purchase Terms & Conditions Agreement

BINDING TERMS AND CONDITIONS OF SALE

The following are the terms and conditions (“Terms and Conditions”) for the sale of products (“Products”) by CEW (“Canada Electronic World Inc “) to CEW (“Canada Electronic World Inc “) customers (“Customers”).

A- ACCEPTANCE AND CANCELLATION OF ORDERS

1. All orders are subject to acceptance in writing by CEW or a duly authorized agent of CEW. Any written acknowledgement of receipt of an order shall not, in itself, constitute such acceptance.

2. Orders accepted by CEW may be cancelled by a Customer upon receiving a written consent from CEW provided such order is not “NC/NR” or “Non-Cancelable/Non-Returnable”, “Non-Standard Products” or governed by a Purchase Agreement Letter.

3. Non-Standard Products are defined as Products that fall under special orders, custom orders, orders for non-standard products, products not customarily in stock or orders for value-added products.

4. Non-standard products are non-cancelable and non-refundable. In the event of cancellation or withdrawal of an order for any unjustified reason, a 50% restocking fee will be applied to cover the product purchasing costs along with all expenses incurred and commitments made by CEW, and shall be paid by the Customer to CEW., and without limiting any other remedy which CEW may have as a result of such cancellation or other withdrawal, reasonable cancellation or restocking charges shall include all expenses incurred and commitments made by CEW, and shall be paid by the Customer to CEW. Customer requests to reschedule are subject to acceptance by CEW in its sole discretion. Invoices not paid on their due dates for either delivered products or partial products stocked and stored on hold to ship out with specified delivery dates stated on the client’s official purchase orders will bear a “Late Payment Penalty Fee of 1% of the order value per each additional 15 days after payment due date at the annual rate as may be the maximum permitted by Quebec law; this late payment penalty fee will be added to the 50% restocking fee invoice upon client order cancellation. 

5. Orders may not be cancelled or rescheduled once they have been submitted by CEW to the shipment carrier.

6. CEW reserves the right to allocate sales and limit quantities of selected Products by its customers in its sole discretion. Product specifications and availability are subject to change without prior notice.

B- TERMS OF PAYMENT

Advanced & Financed (Net Term) Orders

(I). The Customer agrees to pay the entire net amount of each invoice from CEW pursuant to the terms of each such invoice, without offset or deduction. (II). Orders are subject to credit approval by CEW, which may in its sole discretion at any time change the terms of a Customer’s credit, require payment in cash, bank wire transfer/EFT, PayPal, ecommerce or by official bank check and/or require payment of any or all amounts due or to become due for a Customer’s order before shipment of any or all of the Products.

(II). If CEW reasonably believes that the Customer’s ability to make payments may be impaired or if a Customer fails to pay any invoice when due, CEW may suspend the delivery of any order or any remaining balance thereof, until such payment is made, or cancel any order or any remaining balance thereof.

(III). The Customer will remain liable to pay for any Products already shipped and all Non-Standard Products ordered by the Customer. The Customer agrees to submit such financial information as CEW may reasonably require for determination of credit terms and/or continuation of credit terms.

(IV).Checks are accepted subject to collection and the date of collection will be deemed the date of payment. Any check received from a Customer may be applied by CEW against any obligation owing by Customer to CEW under this or any other contract, regardless of any statement appearing on or referring to such check, without discharging the Customer’s liability for any additional amounts owing by the Customer to CEW.

(V).The acceptance by CEW of such check will not constitute a waiver of CEW’s right to pursue the collection of any remaining balance.

(VI). Invoices not paid on their due dates for either delivered products or partial products stocked and stored on hold to ship out with specified delivery dates stated on the client’s official purchase orders will bear a “Late Payment Penalty Fee of 1% of the order value per each additional 15 days after payment due date at the annual rate as may be the maximum permitted by Quebec law.  

(VII). If a Customer fails to make payment when due, CEW may pursue any legal or equitable remedies, in which event CEW will be entitled to reimbursement of costs for collection and reasonable attorneys’ fees.

(VII). There is a $25 (USD) service charge on all returned checks.

C- Limitation Of Liability

You agree to defend, indemnify and hold CEW harmless from and against any and all claims, damages, costs and expenses, including attorney’s fees, arising from or related to your use of this site, CEW shall not be liable for any damages or injury resulting from your access to, or inability to access this site, or from your reliance on any information contained in this site.

YOU AGREE AND ACKNOWLEDGE THAT (I) THE ACTUAL IMPORT FEES MAY BE MORE OR LESS THAN THE ESTIMATE; (II) YOU (AND NOT US, THE BROKER, THE SHIPPER OR ANY OTHER PARTY) MUST BEAR THE RESPONSIBILITY OF PAYING ALL ACTUAL IMPORT FEES; (III) IN THE CASE THAT ANY ENTITY OTHER THAN YOU MUST PAY SOME OR ALL OF THE ACTUAL IMPORT FEES ON YOUR BEHALF TO EFFECT CUSTOMS CLEARANCE, YOU WILL REIMBURSE (UPON REQUEST) THAT ENTITY IN FULL FOR THE ACTUAL IMPORT FEES PAID ON YOUR BEHALF; (IV) FAILURE BY YOU TO PAY IMPORT TAXES IN A TIMELY MANNER MAY CAUSE DELAYS BEYOND OUR ORIGINAL DELIVERY ESTIMATES.

MOREOVER, IF YOU (OR THE RECIPIENT) SUBSEQUENTLY REFUSE OR FAIL TO ACCEPT THE DELIVERY OF THE MERCHANDISE, REFUSE OR FAIL TO PAY IMPORT FEES, AND/OR ATTEMPT TO RETURN THE MERCHANDISE TO AVOID PAYING IMPORT FEES: (1) THE COSTS YOU PREPAID CEW FOR SHIPPING AND/OR HANDLING WILL NOT BE REIMBURSED TO YOU; (2) YOU WILL BE RESPONSIBLE FOR ALL CHARGES RESULTING FROM SAID REFUSAL OR FAILURE TO PAY IMPORT FEES (SUCH AS COSTS FOR SHIPPING AND HANDLING BACK TO CEW AND ANY OTHER FEES RESULTING, DIRECTLY OR INDIRECTLY, FROM YOUR FAILURE TO PAY THE IMPORT FEES); (3) YOU ARE STILL RESPONSIBLE FOR ALL ACTUAL IMPORT FEES; (4) YOU WILL NOT REQUEST THAT UPS, CEW OR ANY OTHER ENTITY REIMBURSE YOU FOR ANY IMPORT FEES PAID; (5) YOU MAY HAVE THE OPTION (DEPENDING ON LOCAL LAWS AND REGULATIONS) TO BE REIMBURSED BY A GOVERNMENTAL OR OTHER AUTHORITY FOR SOME OF ALL OF THE ACTUAL IMPORT FEES (AND YOU SHOULD CONTACT THE LOCAL CUSTOMS OFFICE FOR MORE INFORMATION ON THIS), BUT YOU (AND NOT CEW, UPS OR ANY OTHER ENTITY) WILL BE RESPONSIBLE FOR TAKING ACTION TO TRY TO BE SO REIMBURSED; (6) IF UPS (OR THE SHIPPER, BROKER OR OTHER ENTITY) IN ITS SOLE DISCRETION DECIDES TO ATTEMPT TO DEAL WITH THE IMPORT FEES DIRECTLY WITH A GOVERNMENTAL OR OTHER AGENCY, WE WILL NO LONGER HOLD YOU RESPONSIBLE FOR THE IMPORT FEES; (7) ANY PORTION OWED TO YOU (AFTER ACCOUNTING FOR THE ITEMS DISCUSSED ABOVE) WILL BE REFUNDED TO YOU AND (8) ANY PORTION OWED TO US (AFTER ACCOUNTING FOR THE ITEMS DISCUSSED ABOVE),THAT WE HAVE NOT ALREADY COLLECTED FROM YOU, WILL BE BILLED TO YOU THROUGH YOUR INITIAL METHOD OF PAYMENT.

The detailed policies and agreements are binding to CEW and the Clients in the English language section/portion only of the site. Any agreement to which these Terms and Conditions apply shall be governed and constructed in accordance with Canadian Law and any disputes arising out of or in connection with such agreement shall be determined by Canadian Quebec Courts.
